Daily Maverick - Spain moves to claw back taxes from gaming firms

Internet gaming firms said on Monday that they have been in talks with the Spanish tax authorities in recent weeks over the payment of retrospective taxes for January 2009 to May 2011, a period in which they were in the market without a clear legal framework.

Sweeping new gambling reforms, set to tackle online gambling for the first time and give the state a way into taxing profits in the lucrative sector, have been planned in Spain for some time, and first licences are due to be issued in June.

But the government - struggling with a stagnating economy and making deep spending cuts to hit deficit targets - contacted the major online operators last month to say that two historic laws that had previously not applied to them would now do so.

Although the award of licences is not explicitly linked to the back-duty, companies keen to secure the licences are expected to pay up.

Bwin.party digital, the world's largest listed online gaming company, said in a statement on Monday that it would pay 33 million euros ($42 million) after carrying out a tax self-assessment.

"Having taken these steps, we believe we have now fulfilled all requirements and look forward to receiving our licence and entering the Spanish market," said the Gibraltar-based company, which already has a considerable Spanish profile via its sponsorship of soccer team Real Madrid.

About 60 companies have applied for licences.

Smaller British online gaming firm Sportingbet Plc said it was in talks with the Spanish authorities but gave no further details.

Analysts at Peel Hunt and Barclays Capital estimated that Sportingbet would proportionally be harder hit and is likely to see a tax bill of up to 20 million pounds ($32 million).

Online casino and poker operator 888 is in talks with the Spanish authorities and taking legal and tax advice, a source close to 888 said, adding that any payment was likely to be considerably less than Bwin's $40 million.

Peel Hunt estimates 888's exposure at less than $20 million.

Rival online betting operator Betfair - which earlier this month won one of the first online gambling licences issued in Germany - could not be reached immediately for comment .

As European countries move to regulate what was once a grey area, the risk to betting companies derives mainly from the possibility of others copying Spain's move, analysts said.

But short-term pain could be a long-term gain for the larger operators, who benefit from well-regulated markets, analysts said.

"While this is an initial cash outflow, if it aids the licensing process and leads to more clarity in a key European market, this could be viewed as a positive in the medium term," said BarCap analysts.

Shares in Sportingbet were down 6.2% at 12:40 GMT, while other online gaming firms were largely flat. DM

Former Rutgers student gets 30 days in webcam spying case

A New Jersey judge sentenced ex-Rutgers University student Dharun Ravi to a 30-day jail term and recommended he not get deported back to his native India. Ravi was found guilty in March of bias intimidation, invasion of privacy and other charges after using a webcam to spy on his roommate's intimate encounter with another man.

Updated?6:12 p.m. ET: A New Jersey judge on Monday sentenced a former Rutgers University student accused of using a webcam to spy on his gay roommate's love life to a 30-day probationary jail term.

Indian-born Dharun Ravi, 20, was facing up to 10 years in prison after being found guilty of bias intimidation and invasion of privacy in a case that exploded into the headlines when Ravi's roommate committed suicide. Ravi also was facing the possibility of deportation, but the judge recommended Monday that he be allowed to stay in the country.


Tyler Clementi, 18,?jumped off the George Washington Bridge on Sept. 22, 2010, after finding out that Ravi?saw him kissing another man and appeared to encourage others to watch his romantic encounters through a camera on?his computer.

Parents of Indian-born Dharun Ravi, 20, react to his sentencing for charges of bias intimidation and invasion of privacy in a case that exploded into the headlines when Ravi's roommate committed suicide.

"This individual was not convicted of a hate crime, he was convicted of a bias crime, and there's a difference," Superior Court Judge Glenn Berman said.

"I say that because I do not believe he hated Tyler Clementi. He had no reason to," Berman said, adding that Ravi's crimes were committed out of "colossal insensitivity.?

"I heard this jury say, 'guilty' 288 times -- 24 questions, 12 jurors. That's the multiplication," Berman said. "I haven?t heard you apologize once."

Ravi's sentence also includes three years of probation, 300 hours of community service and a $10,000 fine.

Prosecutors said they plan to appeal the sentence.

"While?the Middlesex County Prosecutor's Office did not request?the maximum period of incarceration for?Dharun Ravi, it was expected that his conviction on multiple offenses of invading the privacy of two victims?on two separate occasions, four counts of bias intimidation against Tyler Clementi,?and the coverup of those crimes,?would warrant more than a 30-day jail term," Prosecutor Bruce J. Kaplan said in a statement.

As Clementi's father, brother, and mother addressed the court, holding back tears at times, the image that emerged was of a "vulnerable" Tyler "shaken by the cold, criminal actions of his roommate.?

"Nobody other than Tyler understood how vulnerable he was," Tyler's father Joseph Clementi said.?"We are seeking justice and accountability, not revenge."

A judge sentenced the former Rutgers University student to 30 days in jail and three years of probation for spying on his gay roommate with a webcam. NBC's Mara Schiavocampo reports.

The family spoke about their long-running ordeal as the media and several court hearings picked apart every detail of Tyler's last days.

"My world came crumbling apart in September 2010,? Tyler's mother Jane Clementi said, adding that Ravi had come to Rutgers with preconceived notions about her son.

"He never really knew Tyler," she said, describing the day she helped her son move into his new room at Rutgers, when Ravi ignored Tyler.

"He could never have known the viper?s nest he was walking into,? Tyler's brother James Clementi told the court, adding that an apology from Ravi would now be empty and spoken without empathy.

"I love my brother and I will mourn for him every day for the rest of my life,? he said.

The court also heard a statement from "MB,"?the man who was watched via webcam as he kissed Clementi. MB described his emotional pain and a combination of embarrassment, emptiness and fear in the wake of Clementi's death and subsequent court proceedings.

"I do wonder if it has ever entered [Ravi's] mind that he has caused me a great deal of pain, and yet he knows nothing about me," MB's statement read.

Ravi did not wish to address the court, but both of his parents spoke, expressing their belief in the American justice system.

In her grief-stricken statement, which was often interrupted by tears and sobs, Dharun's mother Sabitha Ravi told the court his son's life and health have been devastated by the events that occurred over the past 20 months.

She said her son now only eats one meal a day, and has lost more than 25 pounds.

"He was absolutely devastated and broken into pieces,? Sabitha Ravi told the court, as she wiped away tears.

"Dharun?s dreams are shattered and he has been living in hell for the past 20 months," she added, hugging her son after finishing her statement.

Dharun Ravi also cried.

"Contrary to the false propaganda, we are not a homophobic family," Dharun's father Ravi Pazhani told the court. "Dharun was not raised to hate gays."

As the hearing began, the judge noted the court had received letters and petitions asking that Ravi be pardoned. Gay activists also made public pleas for leniency in recent days.

Ravi must report to Middlesex Adult Correctional Center on May 31.

Treating Prostate Cancer with Radiation Therapy | National Male ...

The treatment options for men diagnosed with prostate cancer can depend on many things. With early detected, some men may not need treatment at all.? Doctors may recommend an approach called watchful waiting or active surveillance, which involves regular follow up exams and blood tests to monitor the progression of the cancer.

If it is discovered that the cancer is progressing, your doctor may recommend a treatment option such as radiation therapy.

Radiation therapy, also known as X-ray therapy, uses high levels of radiation to kill cancer cells, and keep them from growing and spreading, minimizing damage to healthy cells. Radiation therapy for the treatment of prostate cancer can be delivered in two ways:

External Beam Radiation

External beam radiation therapy involves using a machine to direct high-powered beams of X-rays towards the site of your cancer. Usually several separate radiation beams are combined to shape the radiation to the prostate cancer.?? This technique is called ?three-dimensional conformal radiation therapy? or ?3D-CRT?. All external beam therapy involves painless radiation treatments that are typically delivered in a series of 30 minute daily sessions over a period of six to ten weeks.

Radioactive Seed Implants

Brachytherapy or internal radiation therapy refers to a procedure that involves implanting radioactive seeds, typically composed of iodine-125 or palladium-103, into the prostate gland. The number of implants and their placement is determined by a treatment plan designed specifically around each individual patient. Anywhere from 40 to 100 seeds can be implanted to treat prostate cancer.? The implants are usually permanent, gradually becoming biologically inert over a period of months. The procedure takes approximately 90 minutes and most patients can return home the same day.

Depending on your specific needs, your doctor may recommend that radioactive seed implants be combined with external beam radiation.? Both treatment methods have similar side-effects, including fatigue and increased urination.? These side-effects typically go away within weeks of completing treatment.

I bet you know this feeling: you bring home a box of perfect, plump, ruby-red strawberries from the supermarket, then you bite into one and you taste absolutely nothing. Close your eyes and you might not even know it's a strawberry at all. Why? Why?

We're hoping Marvin Pritts can help explain. He's a horticulture professor at Cornell University and a berry crop specialist. Professor Pritts, welcome to the program.

MARVIN PRITTS: Thank you. It's good to be here.

BLOCK: And how did this happen? The mass produced strawberry tastes nothing like a fresh strawberry that I might pick from a field. What has that strawberry been bred to do?

PRITTS: So over the last hundred or so years, people have been breeding strawberries for various important traits; size and yield - those are obvious ones, maybe color, disease and insect resistance, flavor. And as you select and try to improve one, oftentimes one of the others has to be sacrificed slightly to make progress.

So we've actually done work where we've taken strawberries from each the decades, for the last hundred years, and planted them in a common field and then evaluated them and see what has changed. And we've seen that size has increased. We've seen that yield has increased. We've seen that firmness has increased. But we've seen that sugar content and flavor has somewhat decreased.

BLOCK: You know, one thing I always wonder about, when I see those perfect strawberries in the supermarket, is the color. Is that actually sun-ripened redness just great from the field or is there something chemically-induced going on there?

PRITTS: There is nothing chemically-induced. But a strawberry that's not quite fully red will turn red even just sitting on the shelf. And that's why the color is sometimes deceiving - it doesn't necessarily mean that it's fully ripe and fully flavorful.

It's too bad that supermarkets don't let you sample before you buy, because that would really change the whole complexion of our supermarkets. So we have to make judgments based on what we see and it's not always reflective of how something tastes. If you could slice the strawberry in half, too, that could tell you a lot. Usually the better flavored strawberries are red through and through. A lot of the strawberries that aren't quite so flavorful are white - they're red on the outside but white on the inside.

BLOCK: One thing you mentioned earlier was size, that we like bigger strawberries. Why the focus on larger fruit? Why has that become so dominant, do you think?

PRITTS: I think for two reasons. One is Americans just naturally think bigger is better. Then the other factor, particularly with smaller size fruit like strawberries, is because of the labor situation being so expensive and difficult to obtain. It's a lot faster to pick a flat of strawberries when the strawberries are large, then it is when the strawberries are small. Large strawberries saves you a lot of money and labor.

BLOCK: Marvin Pritts, when you're buying a strawberry, what do you look for?

PRITTS: The first thing I do is look for where they are grown. If I have a choice I buy the strawberries that are grown closest to where I live, because I know that those are the ones that are probably going to be picked the closest to being fully ripe. Then I look for strawberries that have a nice shape, that are red all the way through, all the way around. Because I know, again, those are close to ripeness.

But I don't want strawberries that are so right that they start to decompose or mold or get watery inside the package.

BLOCK: And then you just cross your fingers and hope that they taste like something.

(SOUNDBITE OF LAUGHTER)

PRITTS: That's right. And, you know, the breeders don't intentionally select for strawberries that don't taste good. It's just that it's hard to have that flavor and everything. So, sometimes they hit a homerun and end up with something that's really high yielding and productive, and tastes really great, too. But a lot of times they don't quite get there.

How it All Began

By the summer of 2006, it was reported that thousands of videos were being uploaded every day and millions of viewers were watching clips per day. Numbers continued to increase and moved into the billions by 2010. Since then, YouTube has embarked on several new concepts, such as the ability to upload full-length videos and the free streaming of specific content. A new design was also launched to provide additional benefits to users.

Today, YouTube is headquartered in San Bruno, California. After being acquired by Google, the Google+ social networking site was integrated with YouTube which allow the site?s videos to be viewed from Google?s interface. YouTube is a dominant force in the online business market in the United States and it also ranks relatively high in other regions, including the United Kingdom. As of 2012, more than 4 billion videos are streamed per day.

Panel debates bioterrorism protection for children

WASHINGTON (AP) ? The Obama administration is asking a presidential commission to help decide an ethical quandary: Should the anthrax vaccine and other treatments being stockpiled in case of a bioterror attack be tested in children?

"We can't just assume that what we have for adults works for children," Health and Human Services Secretary Kathleen Sebelius told the panel Thursday.

Controversy over whether to open pediatric studies of the anthrax vaccine led Sebelius to ask the Presidential Commission for the Study of Bioethical Issues to tackle the question. The commission began its deliberations Thursday; recommendations are expected by year's end.

Sebelius made clear that the question is far broader than anthrax.

"There are serious ethical issues around the development of medical countermeasures for children" in general, she said.

Developing protections for youngsters is critically important, but in a way that puts "our children's safety as our highest priority," Sebelius said.

A decade after the anthrax attacks in the United States, the government has a multibillion-dollar stockpile of tools to fight back against some of the threats that worry defense experts. Notably missing is information on how to treat children in various emergencies ? whether the same drugs their parents will get will work or be safe for them, and even what dose youngsters should receive.

Thus the debate on whether to conduct studies now, before millions of children might need to try an untested product in an emergency. Even if those studies were offered, there's no way to know how many parents would agree to enroll their children.

Testing medications in children always requires extra safeguards. It's fairly straightforward to test a potential treatment for cancer or some other childhood disease. But if a child won't receive a direct medical benefit, federal regulations say studies are allowed only if testing adults can't provide the answers and if the risks to participating children are minimal.

Anyone exposed during an anthrax attack would require 60 days of powerful antibiotics, or antibiotics until a vaccine could kick in. Last fall, the National Biodefense Safety Board, which advises the government, recommended child testing of the anthrax vaccine, but only if outside ethical experts agreed such studies could be done appropriately.

The shots have been widely used in adults, including U.S. troops, and are considered safe for them, said the board chairman, Dr. John Parker, a retired Army major general who has been vaccinated.

Side effects include shot-site soreness and redness, muscle aches, fatigue and headache. Rare but serious allergic reactions have been reported.

The bioethics commission wrestled with how to define "minimal risk" when there is no imminent emergency, and the chairwoman, Dr. Amy Gutmann, wondered whether people urging such testing would enroll their own children.

Parker responded that he's discussed that with first-responders and some in the military. "There are groups out there that would want their families protected as much as they are protected as they do their job, in fear of bringing something home," he said.

Other doctors told the panel that 60 days of antibiotics can cause bad side effects for children, including diarrhea, other infections and dangerous allergic reactions. Plus there's concern that many people wouldn't take the full course, Parker said.

NBA: Bulls Derrick Rose Out 8-12 Months; Could Miss All of Next Season

Chicago Bulls?guard?Derrick Rose?will be out at least 8-12 months after undergoing surgery to repair his left ACL, said Dr. Brian Cole, who performed the surgery on Saturday.

The 23-year-old Rose tore the ACL on April 28 during the first game of the Bulls? Eastern Conference quarterfinal series against thePhiladelphia 76ers. Without Rose, the Bulls became only the fifth No. 1 seed to lose to an eighth seed as the Sixers won in five games.

?Derrick is doing great,? Cole said Tuesday at a press conference at Rush University Medical Center. ?The surgery went extremely well. Really no surprises. It was pretty routine.

?We?re at this point very optimistic. ? We think of recovery as the long process that?s in stages. But the short answer is the time frame we believe an athlete of this caliber generally requires is about 8-12 months. Sometimes shorter, sometimes longer.?

That means Rose is likely to miss at least the first two months of next season, or he could miss the entire season.

Bulls general manager Gar Forman said Rose was ready for rehabilitation.

?In the time frame I?ve spent with him, and I was with him over the weekend, his spirits seemed really good,? Forman said. ?In his mind, he?s determined to attack this rehab and get back to the level that he was at.

?There was a period when he was down. But I think his spirts are good under the circumstances and I think he?s ready to aggressively attack this.?

Even if I add up all the PC games I've ever got in the last 17 years, it still comes to an average of one new game a year.? I might not be hardcore in the sense of getting many types of games, but I don't get bored easily with the games I have, so every chance I get I'm always playing something;?I'm not casual.?

The primary difference between A-train and Simcity with Warcraft was that the A.I. was actively fighting against me,?pushing a new challenge level.? This got me hooked on Microsoft Ensemble's Age of Empires and Mythology series of RTS', as well as Sierra's World in Conflict.? Never got into Total War or Civilization series yet, don't plan to.? Although, Age of Empires 3 was the first RTS game to tell me my computer was slow, lowest settings gave me 9-15 frames per second.? The chipset was an Intel 845G.

This was the first game that told me my computer was slow (AoE3 came a year later), although I only upgraded the RAM as I had a Dell Inspiron 1100 laptop.

With RTS and simulators, the mouse is independent of vision, so I never noticed that my hands were always moving all over the map.? With first-person, your mouse is your eyes/neck and suddenly I got dizzy fast and didn't know why and didn't like that game.? This wasn't something motion sensitivity would fix, I had to change how I played a game, that took a while.

Even afterwards I got into F.E.A.R. (2006), HL2 (2007), Crysis (2008), Mirror's Edge (2009), Halo 2 (2010) and Crysis 2 (2011)?in that order.?I'm pretty conservative with games I do get and not to read too much about them,?so I love every single one and don't ruin the experience (unlike many that read too much and build up their own idea of what to expect only to feel let down when it wasn't, then they blame the developer rather than themselves-- I'm not like that).

I want to get into the rest of the Halo series, just not yet willing to get an Xbox for it; nothing to do with image quality:? I'm not into other Xbox games and a console isn't a PC in terms of more than gaming, internet, movies or music?so it would sit there until I use it.? New shear touch technology lets you skip a double-tap, push your device around (video)

Most every touchscreen in the market today can only register your finger input as coordinates; that's fine for most uses, but it leads to a lot of double-taps and occasionally convoluted gestures. A pair of researchers at Carnegie Mellon University, Chris Harrison and Scott Hudson, have suggested that shear touch might be a smarter solution. Instead of gliding over fixed glass, your finger could handle secondary tasks by pushing in a specific direction, or simply pushing harder, on a sliding display. Among the many examples of what shear touch could do, the research duo has raised the possibility of skipping through music by pushing left and right, or scrolling more slowly through your favorite website with a forceful dragging motion. The academic paper is still far away from producing a shipping device, although a Microsoft doctoral fellowship's partial contribution to funding the study indicates one direction the technology might go. You can take a peek at the future in a video after the jump -- just don't expect a tablet-based Van Gogh this soon.

Nokia Reading opens its pages to select European nations, more to follow

Nokia's not shy when it comes to decorating the Lumia halls with proprietary and partnership apps. The latest addition? That Nokia Reading app we first saw announced at MWC. Owners of Lumia 900, 800, 710 and 610 phones in France, Germany, Italy, Russia, Spain and the UK will be able to get their thumbs amidst those digital pages over the next few weeks, while unspecified "other" countries can look forward to it some time later in the year. Espoo is keen to point out that there'll be an emphasis on "own language" titles, but also a large collection of English language best sellers for which translations aren't available. It's just the written word for now, but audio books and news feeds will be introduced later. Let's just hope you finish reading The Color Purple by then.

HTC EVO 4G LTE for Sprint review

HTC is on a roll in the US, first releasing the One S for T-Mobile and the One X for AT&T. Now, with the EVO 4G LTE on Sprint, it's ready to shift to the CDMA realm in a different costume. Internally, it's incredibly close to what's offered in the One series' flagship, but the Now Network has made a few tweaks to the device so it'll adjust to life as the latest smartphone in the fabled EVO lineup. This time it's packing a powerful processor, gorgeous display and the ability to connect to the still-dormant LTE. It's eager to show its face in retail stores beginning May 18th for $200, placing it in the high end of Sprint's selection.

This review, however, is just a bit different from any we've done before. How so? To our knowledge, we've never done one in New Orleans before. But when a phone gets dropped in our lap at CTIA 2012, we're naturally going to put it through its paces, regardless of location. As it shares so many commonalities with its One brethren, we've been expecting a very similar fit, feel and performance. In our review, we'll take you through what's different and what's better or worse. Is this the best device to grace the hands of Sprint customers? Follow us past the break to find out.
